Buying and Selling

Commercial property includes, factories, warehouses, shops and offices.  Although there are similarities between buying a house and, for example, buying a warehouse with offices, there are sufficient significant differences to mean that it is necessary to obtain advice and assistance from an experienced practitioner in relation to commercial property.

We deal with the legal processes liaising where necessary with Banks in relation to funding.

Leases and Licenses

Companies frequently take or grant a lease of premises where they own them for investment purposes or wish to take advantage of the flexibility of rented property.

It is important that the lease properly incorporates the basic terms agreed between the landlord and tenant and does not include any pitfalls for either party.

Leases over seven years must be registered at the Land Registry and frequently Stamp Duty Land Tax must be paid.

We advise on all aspects of Commercial Leases ensuring that the appropriate terms are incorporated and the owners are properly registered at the Land Registry.

Sometimes circumstances dictate that it is more appropriate for a business to have a licence to use premises; this is often in temporary circumstances or where the area of space being taken is relatively modest.

Licences and leases are two distinct sets of arrangements and we will ensure that the correct documentation is drafted and agreed to suit the circumstances.

Property Development and Pensions

We act as solicitors for a number of companies whose business solely relates to property. This includes buying and developing land for commercial or private buildings.  We assist in the initial purchase and then the subsequent sales or lets of houses, apartments or units.

More and more nowadays Pensions are becoming involved in properties for investment purposes and we act for a number of pension trustees advising them on the law and procedures to ensure that the transactions complete in accordance with the relevant laws.
